Pension advocacy - Legacy

Legacy has expertise in understanding the individual situations and entitlements of the partners and dependent children of deceased members of the Australian Defence Force and eligible merchant mariners.

Legacy has a nationwide network of trained and experienced Pension Officers who are available to assist eligible families to access their entitlements including:

Government Superannuation - assisting widows to claim benefits under superannuation schemes such as ComSuper, DFRDB and MSBS

Military Compensation – claims for War Widows pensions and dependant benefits under the Veterans Entitlement Act 1986, Military Rehabilitation and Compensation Act 2004 and the Safety, Rehabilitation and Compensation Act 1988.

Commemoration – entitlements to war graves through the Office of Australian War Graves. Assistance with claiming campaign and long service medals from the Department of Defence.

Income Support – claims for income support from the DVA such as the Income Support Supplement and Service Pension and through Centrelink for Age Pensions

Associated Benefits - accessing benefits provided to eligible persons through the DVA and Centrelink.

If initial claims for pensions and benefits are unsuccessful but have merit, Legacy will assist applicants to appeal to the appropriate bodies, such as the
Veterans’ Review Board and the Administrative Appeals Tribunal.

These services are provided at no cost to widows/ers.

In addition to assisting eligible dependants to prepare claims for pensions and other benefits, Legatees also provide ongoing advice and assistance.
